A BILL to amend article two, chapter thirty-one of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
sixteen, relating to requiring that a railroad employee be
at each end of a train that employs a pushing force to
propel railroad cars; and providing for a fine for violating
this section.
Be it enacted by the Legislature of West Virginia:
That article two, chapter thirty-one of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
sixteen, to read as follows:
ARTICLE 2. RAILROAD COMPANIES.
§31-2-16. Requirement for shoving railroad cars; penalty.
A railroad employee shall be at each end of a train that
employs a pushing force to propel railroad cars. No train
originating in another state and that employs a pushing force to
propel railroad cars shall enter this state unless a railroad
employee shall be at each end of the train. Any organization who
violates a provision of this section shall be guilty of a
misdemeanor, and, upon conviction thereof, shall be fined five
thousand dollars for each violation.
NOTE: The purpose of this bill is to require that a
railroad employee must be at each end of a train that employs a
pushing force to propel railroad cars; and to impose a fine for
a violation of this section.
